VodafoneZiggo Does Not Have to Share its Cable Network in Amsterdam

The Authority for Consumers and Markets (ACM) has decided that VodafoneZiggo in Amsterdam does not have to share its cable network with third parties. This is in response to the demand of internet provider YouCa to gain access to this network.

Sufficient Telecom Providers in Amsterdam

According to ACM, there are sufficient telecom providers active in Amsterdam to install fiber optic connections to which multiple providers are allowed. In addition, several options for high-speed internet access will be available to the majority of Amsterdam residents within three years.
ACM believes that access to telecom networks for third parties is only necessary if fast broadband is not widely available. This is clearly not the case in Amsterdam. Therefore, VodafoneZiggo does not have to open up its existing cable network in the capital to third parties. The telecom and internet giant also does not have to give access to its network of street cabinets.

YouCa Disappointed in Draft Decision

Internet provider YouCa has been trying since 2009 to gain access to VodafoneZiggo’s Amsterdam cable network in order to offer services there. In response to ACM’s decision, the alternative internet provider indicates that it disagrees with the draft decision. According to YouCa, this would only leave room for a duopoly of VodafoneZiggo and KPN in Amsterdam.
YouCa also accuses the regulator of a lack of market insight and of lacking the courage to stand up for consumer rights. YouCa wants to go politics and is convinced that he is right and will probably also appeal against the draft decision.
